Notice of Proposed By-Laws Amendment

The Michigan Association of Municipal Clerk’s Board of Directors, at the meeting held April 15, 2015, unanimously voted to adopt Standing Rule 46 Code of Professional Ethics and Conduct-MAMC Directors.  At this meeting the Board also voted to put ARTICLE XIV CODE OF PROFESSIONAL ETHICS AND CONDUCT for all membership, a By-Laws Amendment, before the Membership to be voted on at the 2015 MAMC annual meeting.

Proposed By-Law Amendment
 
ARTICLE XIV  CODE OF PROFESSIONAL ETHICS AND CONDUCT.
  
Section1.  Purpose
This Code of Professional Ethics and Conduct ensures a uniform adherence to the Association’s long-standing policies related to legal, moral and professional standards of conduct.  The principles set forth in this code will govern the conduct of all members of the Michigan Association of Municipal Clerks.
 
Section 2.  Fiduciary Responsibility
A member will exercise prudence and integrity in the management of funds in his/her custody and in all financial transactions for which he/she is responsible and will maintain the safety of monies placed in his/her public trust.
 
Section 3.  Responsibility as Public Officials
A member will adhere to concepts of effective and efficient local government service being provided by elected and appointed Public Clerks, Deputy Clerks and Election administrators.  A member will conduct himself/herself at all times in a manner which serves the public interest and enhances the stature of the profession. A member will uphold the letter and spirit of the law and report violations of the law to the appropriate authorities.    
 
Section 4.  Professional Development
A member will observe professional technical standards and continually strive to acquire knowledge and improve levels of competence in the statutory duties of the Clerk.  
 
Section 5.  Professional Integrity – Information
A member will respect and protect privileged information.  A member will conduct government openly so the public may make informed judgements and hold public officials accountable.
 
Section 6.  Professional Relationships
A member will maintain the highest ideals of honor, integrity, and objectivity in all professional relationships.
 
Section 7.  Interactions with Others
Any form of discrimination or harassment that violates policy will not be tolerated. This policy forbids any unwelcome conduct that is based on an individual’s age, race, religion, sex, national origin, ancestry, marital status, sexual orientation, gender identity, veteran status, physical or mental disability, legally protected medical condition or association with anyone who has, or is perceived to have, any protected characteristic, or any other basis protected by state, federal or local law.

Section 8.  Conflict of Interest
A member will not seek any favor or accept any personal gains which would influence, or appear to influence, the objectivity or conduct of official duties.
 
Section 9.  Member Misconduct
A member found by the Board of Directors to be in violation of any provision of this Code of Ethics and Conduct will be expelled from membership for a length of time to be determined by the Board and, if the member holds the designations of Certified Michigan Municipal Clerk, the Board may vote to revoke the designation; Certified Municipal Clerk and or Master Municipal Clerk the Board may request that the International Institute of Municipal Clerks Association revoke the designation.
 
By accepting membership in the Michigan Association of Municipal Clerks each member agrees to be bound and governed by this Code of Professional Ethics and Conduct.
 
In accordance with MAMC By-Laws Article XII AMENDMENTS. These bylaws may be amended at any meeting of the Michigan Association of Municipal Clerks by a 2/3 vote of the membership present and voting so long as notice of the proposed amendment is provided to each member no less than 30 days in advance of the meeting in which the amendment shall be voted on.  The membership will vote on this at the Annual Meeting to be held at the 2015 Annual Conference June 23-26, 2015, on Mackinac Island.

Notice of Proposed By-Laws Amendment

The Michigan Association of Municipal Clerk’s Board of Directors, at the meeting held March 16, 2015, unanimously voted to change the membership rate structure. Records indicate that rates have not been changed since MAMC’s inception in 2000. Additionally, at the General Meeting held during the June 25, 2014, the membership voted to amend the By-Laws Article III Membership. Section 1. Active Members permitting all active members to cast a vote, debate, attend meetings and classes, and cast a vote for Clerk of the Year. The following changes are proposed:
  1. Eliminate population breakdowns
    • Population 5000 or under
    • Population over 5,000
  2. Establish one common fee for all Active Members: $60.00.
Active Member: $60
Population 5000 or under: $50
Population over 5000: $60
Additional Membership: $40
 
In accordance with MAMC By-Laws Article III Membership. Section 5. Dues. The dues shall be determined by a majority vote of the members of the Michigan Association of Municipal Clerks present at any regular or special meeting, so long as notice of the dues structure is provided to each member no less than 30 days in advance of the meeting in which the dues change shall be voted on. The membership will vote on this at the Annual Meeting to be held at the Annual Conference on June 23-26, 2015, on Mackinac Island.
